Statement From A.G. Schneiderman On Today’s D.C. Circuit Decision Dismissing Challenges To EPA’s Proposed Clean Power Plan

NEW YORK – June 9, 2015 – (RealEstateRama) — Attorney General Eric T. Schneiderman today released the following statement on the U.S. Court of Appeals – D.C. Circuit’s decision dismissing challenges to the U.S. Environmental Protection Agency’s Proposed Clean Power Plan:

“I applaud the D.C. Circuit’s decision today unanimously dismissing challenges to the EPA’s proposed Clean Power Plan. The EPA can now focus squarely on finalizing the rule to require that the largest sources of carbon pollution in the country—fossil-fueled power plants—reduce their emissions to stem the tide of the harmful consequences of climate change.”

Attorney General Schneiderman led a coalition of twelve states and two cities that filed briefs and argued on the EPA’s side in the challenges: Murray Energy v. EPA and West Virginia v. EPA.

This case was handled by Assistant Attorneys General Michael Myers, Morgan Costello, and Brian Lusignan of the Environmental Protection Bureau and Assistant Solicitor General Bethany A. Davis Noll and Deputy Solicitor General Steven C. Wu of the Appeals & Opinions Division. The Environmental Protection Bureau is led by Bureau Chief Lemuel M. Srolovic.
